The Communications Council provides guidance to assist members in maintaining compliance with industry codes and regulatory frameworks, in addition to business operations and team management. This service is strictly for members only and can be accessed by any individual within the member agency.

Guidance is provided in three key areas; legal, employment and business management.

We work with von Muenster Solicitors & Attorneys as our industry partner in providing up to date, relevant guidance for marketing communications specialists. Backed by the collective experience of VM Solicitors and the Communications Council, this guidance is an important tool in ensuring campaigns meet regulatory standards. 

How this works
A number of options are available to members to provide flexibility in managing client and agency expectations, budgets and deadlines.

Option 1: Topline Codes, Legal and Regulatory Guidance

Topline codes, legal and regulatory guidance is available to members over the phone. Call or email the Communications Council at query@communicationscouncil.org.au or (02) 8297 3800.

Your query will be addressed with a response from either a Communications Council representative or VM Solicitors.

Option 2: Legal Clearance/reviews of Material

This process is high level and identifies roadblocks, legal risks and makes recommendations. Clearance and advice is provided in writing by VM Solicitors. Each member agency receives 2 complimentary clearances per year (commencing January 2015). Subsequent approvals/guidance is provided at $300+gst per query.

To access clearance advice, please contact the Communications Council with the following:

 

  • Agency and client
  • Brief description of issue
  • Indicate what aspect of the campaign material you require clearance on (eg/ use of celebrity image)
  • Deadline for written advice

Option 3: More Complex Legal Challenges, Advice and Services

For more complex legal challenges, advices and services, members can engage directly with VM Solicitors at preferential rates. The types of services available include:

 

  • brand protection and trade marks
  • client relationships – agreements, services
  • consumer protection compliance
  • customer data use and protection
  • dispute resolution
  • intellectual property advice and protection
  • privacy and SPAM compliance
  • social media legals including risks advice and reduction
  • complex activations and promotions
  • PR and earned media

  Employment Guidance

Comms Council Professional Development

Partnering with workplace relations experts Employsure, guidance in this area assists agencies meet legal obligations in employment with practical and relevant tools for employee management.

Option 1: Over the phone support

Members can access advice over the phone support directly with Employsure for issues including:

 

  • Application of FairWork Act
  • Redundancy management
  • Bullying
  • Salary benefits packaging

Option 2: More Complex Issues

For more complex issues requiring comprehensive written legal advice, members can engage Employsure at preferential rates.
